ARTICLE 6 - Prices
The Products are provided at the prices in effect as displayed on the Website at the time of order registration by the Seller. The prices are stated in Euros, excluding taxes (HT) and including taxes (TTC). The prices include handling and packaging fees but do not include shipping fees.
For all Products shipped outside of mainland France, Corsica, and overseas territories (DOM-TOM), the price will be automatically calculated excluding taxes on the invoice.
When prices are indicated as TTC, the applicable VAT is the legal rate in force on the day of the order, and any change in the rate will be automatically reflected in the displayed prices. The Seller's intra-community VAT number is FR35887915536.
The prices take into account any discounts granted by the Seller on the Website.
These prices are firm and non-revisable during their validity period, as indicated on the Website. The Seller reserves the right to modify the prices at any time and without prior notice outside of this validity period. The delivery fees are invoiced separately, under the conditions indicated on the Website and calculated prior to placing the order.
If the Customer requests a faster or more expensive shipping method than the standard shipping, the additional delivery fees, as displayed at the time of order validation by the Customer, will be entirely borne by the Customer.
The payment requested from the Customer corresponds to the total amount of purchases, including these fees.
The delivery/shipping rates in mainland France are as follows for regular parcels:
- Standard delivery to the address provided by the Customer, with delivery to the mailbox without signature: 4.90 euros TTC.
- Express delivery to the address provided by the Customer, with delivery to the mailbox without signature: 8.90 euros TTC.

In the case of opting for a reusable package, the Customer will have to pay a deposit fee of 2 euros in addition to the delivery/shipping fees.
Deliveries outside of mainland France and Corsica are billed on a case-by-case basis according to the destination. The Customer is informed of this at the time of finalizing the order process.
Upon request, the Customer can obtain the issuance of an invoice to a billing address different from the delivery address.
ARTICLE 7 - Payment Conditions
The price is payable in full on the day the order is placed by the Customer, using a secure payment method, such as credit cards: Visa, MasterCard, American Express, and other credit cards.
Payment by credit card is final, except in cases of fraudulent use of the card. In such cases, the Customer may request the cancellation of the payment and the corresponding refund.
Online payment is made through SSL encryption to protect sensitive payment information. The payment for orders is processed through "Stripe," and the Seller covers the management fees. Any other fees, regardless of the reason, will be charged to the Customer.
The Customer expressly acknowledges that providing their credit card number to the company "les minettes en goguette" authorizes the debit of their account for the ordered Products.
The Seller reserves the right to suspend or cancel any Order or Pre-order and any delivery in case of refusal of payment authorization by the officially accredited organizations or in case of non-payment.
Payment in installments is offered through the "Alma" solution. This option for the Customer implies prior acceptance of the supplier Alma's general customer terms and conditions, available here. In particular, the Customer acknowledges that eligible purchases for installment payments are those with amounts ranging from €1.00 to €2,000.00.
ARTICLE 8 - Deliveries
8-1. General
The Products are delivered to the delivery address provided by the Customer during the order, with the understanding that deliveries are not possible to hotels or PO boxes. It is the Customer's responsibility to provide all necessary information to ensure the accuracy and completeness of the address details for smooth delivery. Otherwise, the Seller cannot be held responsible for delivery difficulties. The Products will be returned to the Seller's premises, and the Customer must contact the Seller's Customer Service to arrange for the retrieval of their Products. The return costs will be borne by the Customer.
Delivery is considered complete when the Customer takes physical possession or control of the Product.
8-2. Delivery Times and Methods
Products in stock ordered by the Customer will be delivered in mainland France within an average period of 1 to 3 business days, and outside mainland France within an average period of 8 business days from the date of shipment by the Seller.
The Customer acknowledges that in the case of pre-orders, the delivery time may be extended. The estimated delivery time is indicated on the Product page at the time of purchase and in the pre-order confirmation email. The delivery time depends on the necessary time and volume of production for all pre-ordered products and ranges from 4 to 6 weeks after validation of the manufacturing process. Once in stock, the pre-ordered Product is shipped and delivered within the same time frame as orders for Products in stock.
Delivery is made upon the handover of the Products to the Customer by the carrier or at the designated Pickup Point, as indicated by their respective control systems.
Unless otherwise specified or in case of unavailability of one or more Products, the ordered Products will be delivered in a single shipment. In the event of partial shipments, the shipping costs will be charged only once.
The Seller offers delivery via traditional parcel or reusable parcel.
At the time of ordering, the Customer may choose the reusable parcel system provided by the partner OPOPOP (https://opopop.co/notre-offre/). The Customer receives their order and, if satisfied with the item, simply needs to return the empty package for free in any yellow mailbox.
If the item is not suitable, the Customer can return it in the sealed package following the return procedure.
The Products are delivered:
- either by "So Colissimo" with delivery (without signature) to the mailbox. The usual delivery time for the products is 1 to 3 business days after the processing and shipment of
the package by the Seller (normal delivery time given by the postal service). If the package is too large to be delivered to the mailbox, a delivery notice may be left, indicating the post office where the package will be held for 2 weeks.
- or through Point Mondial Relay locations specified on the website for orders to be delivered in mainland France. The usual delivery time for the Products is 1 to 3 business days after the processing and shipment of the package by the Seller (normal delivery time given by Mondial Relay). The Customer will receive an SMS and email confirming the availability of their order at the selected Point Mondial Relay, which they chose during the order (or the nearest Point Mondial Relay in case of overload or exceptional closure of the selected Point). The order will be held for 10 business days at the Point Mondial Relay. To retrieve the order, the Customer must present the withdrawal receipt previously sent by Mondial Relay via SMS, the customer notification email, and a valid identification document.
In both cases, the Customer receives via email the details for tracking the order (tracking number and link to the carrier's website).
The Seller undertakes to make every reasonable effort to deliver the ordered Products to the Customer within the specified time frames. However, these time frames are expressed in business days and provided as indicative. If the ordered Products have not been delivered within a reasonable additional period of 14 days after the conclusion of the contract, for any reason other than force majeure or the Customer's fault, the sale can be resolved at the Customer's written request under the conditions provided for in Articles L 216-2, L 216-3, and L241-4 of the Consumer Code. The amounts paid by the Customer will then be refunded within 14 days following the date of termination of the contract, excluding any compensation or withholding.
The Customer acknowledges that in the case of pre-orders, the aforementioned additional delivery time is extended to 8 weeks after the pre-order, due to the observed manufacturing time.
8-3. Delivery Issues
The Seller guarantees that the Products are handed over to the carrier in perfect condition.
The Customer is required to check the condition of the packaging and the conformity of the delivered Products as soon as the package is handed over by the carrier or picked up at a Point Mondial Relay. Any claim regarding the non-conformity of the delivered Products must be notified by the Customer, by registered letter with acknowledgment of receipt sent to the company "les minettes en goguette," 10 rue de la République, 13001 Marseille, or by email to the following email address: contact@lesminettesengoguette.com, within 72 hours of receiving the Products, as well as to the carrier whose contact information is as follows: Mondial Relay, Customer Relations Service, 5 Avenue Antoine Pinay, 59510 Hem - 09 69 32 23 32 (local call rate).
The Customer must provide the Seller with any necessary justification for their claim. If the claim is accepted by the Seller, the Customer may benefit from the refund or exchange conditions provided for in Article 12-3 below. In the absence of a claim made within the aforementioned deadlines, the Products will be deemed conforming and accepted by the Customer.
The Seller bears the risks of transport and is obligated to reimburse the Customer in case of damages caused during transportation, provided that the reservations have been made in the prescribed conditions and the damages are justified.

ARTICLE 10 - Transfer of Ownership - Transfer of Risks
The transfer of ownership of the Seller's Products to the Customer will only be made after full payment of the price by the Customer, regardless of the date of delivery of said Products.
Regardless of the date of the transfer of ownership of the Products, the transfer of the risks of loss and deterioration relating to them will only be made when the Customer physically takes possession of the Products. Therefore, the Products are transported at the risk and peril of the Seller.
ARTICLE 11 - Right of Withdrawal
In accordance with the current legal provisions, the Customer has a period of fourteen (14) days from the receipt of the Product to exercise their right of withdrawal with the Seller, without having to justify reasons or pay penalties, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within fourteen (14) days following the notification to the Seller of the Customer's decision to withdraw.
Products that have been worn, washed, damaged, soiled, or incomplete will not be accepted for return.
Only the Customer who placed the order is entitled to exercise this right of withdrawal. In the case of delivery to a different person, they will not be able to exercise this right.

Company "Les Minettes en Goguette" 10 rue de la République 13001 Marseille France
The right of withdrawal can be exercised online using the withdrawal form available on the Website, in which case an acknowledgment of receipt on a durable medium will be immediately communicated to the Customer by the Seller, or by any other unambiguous statement expressing the intention to withdraw.
The right of withdrawal can also be exercised via the printed form placed in each package.
In the event of the exercise of the right of withdrawal within the aforementioned period, only the price of the purchased Product(s) and the delivery costs will be refunded.
The return costs are covered by the Seller.
The refund will be made by crediting the Customer's bank account used for payment, within a maximum period of 14 days from the notification to the Seller of the decision to withdraw.
ARTICLE 12 - Seller's Liability - Warranty
The Products sold on the Website comply with the current regulations in force in France.
The Products provided by the Seller benefit automatically and without any additional payment, independently of the right of withdrawal, in accordance with the legal provisions,
from the legal warranty of conformity for Products that are apparently defective, damaged, or not in accordance with the order;
from the legal warranty against hidden defects arising from a defect in material, design, or manufacturing affecting the delivered products and rendering them unfit for their intended use.
12-1. Legal Warranty of Conformity
The Products are subject to the conditions of the legal warranties provided for in Articles L217-4 to L217-23 of the Consumer Code.
Thus, in accordance with Article L211-4 of the Consumer Code, the Seller is obliged to deliver goods that are in conformity with the contract and is responsible for any lack of conformity existing at the time of delivery. The Seller is also responsible for any lack of conformity resulting from packaging.
In accordance with Article L217-5 of the Consumer Code, for the Product to be considered in conformity with the contract, it must:
be suitable for the usual expected use of a similar good and, where applicable: correspond to the description given by the Seller and possess the qualities that the Seller presented to
the buyer in the form of a sample or model; or have the qualities that a buyer can legitimately expect based on the public statements made by the Seller, the producer, or their representative, particularly in advertising or labeling; or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the Seller's attention and accepted by them.
However, the Customer becomes solely responsible for the choice of Products from the moment of delivery and their use. Under no circumstances can the Seller guarantee that the order meets the Customer's expectations.
It is recalled that, within the framework of the legal warranty of conformity, the Customer:
-
has a period of two (2) years from the delivery of the Product to take action against the Seller;
-
may request the replacement of the ordered Product, subject to the cost conditions provided for in Article L 217-9 of the Consumer Code, to the extent that the repair of the Product is deemed impossible due to the nature of the Seller's Products;
-
is exempt from providing proof of the existence of the Product's lack of conformity during the twenty-four months following the delivery of the Product.
12-2. Legal Warranty against Hidden Defects
In accordance with the provisions of Articles 1641 and following of the Civil Code, the Seller is liable for hidden defects, meaning "defects in the thing sold that render it unfit for its intended use, or that so diminish its usefulness that the buyer would not have acquired it or would have given it a lesser price if they had known about them."
It is recalled that, within the framework of the warranty against hidden defects, the Customer:
-
has a period of two (2) years from the discovery of the defect to take action against the Seller;
-
has the choice of returning the Product and being refunded the price or keeping the Product and being refunded a part of the price in accordance with Article 1644 of the Civil Code.
12-3. Implementation Procedures
In order to assert their rights, the Customer must inform the Seller in writing of the non-conformity of the Products within a maximum period of 72 hours from the delivery of the Products or the discovery of the hidden defects within the aforementioned time limits, and return the defective Products in the condition in which they were received, with all elements (accessories, packaging, instructions, etc.).
The Seller will refund or replace the warranty-covered Products that are deemed non-conforming or defective.
The shipping costs will be reimbursed based on the invoiced rate, and the return costs will be reimbursed upon presentation of supporting documents.
Refunds for non-conforming or defective Products will be made as soon as possible and no later than 14 days following the Seller's acknowledgement of the lack of conformity or hidden defect.
The refund will be made by crediting the Customer's bank account.
The Seller's liability cannot be engaged in the following cases:
non-compliance with the legislation of the country to which the Products are delivered, which is the Customer's responsibility to verify; in case of misuse, professional use, negligence, or lack of maintenance on the part of the Customer, as well as in case of normal wear and tear of the Product, accident, or force majeure.
In any case, the Seller's warranty is limited to the replacement or refund of non-conforming or defective Products.
